Civil Suit Serious Consequences My Prison Life
 
Introduction

I am an Indian national. After my study in Electro-Mechanical from Victoria College of Eng. Bombay, I worked in projects of international repute and in concerns of great tradition and international acceptance like Voltas and Lufthansa. In the year 1979 (June 1, 1979) I migrated to United Arab Emirates for better prospects in my profession. It was at the early stage of development in UAE, that I commenced my activities. I was associated with Hamorabi Electrical Contractors, Abu Dhabi. 

After a long struggle over a period of years, I was able to establish a group of concerns by myself Ramla Electro-Mechanical Establishment, Premier General Contracting Est. and Summer pool Trading Est. All these were approved by Municipal Corporation of Abu Dhabi. With dedicated hard work for over 18 years and spending the prime of my life, I helped to build the economy of that country and earned foreign exchange for my own country as well.

On behalf of my principal, Premier General Contracting Est., I entered into a contract with Mr. Hassan Saeed, a local belonging to Abu Dhabi, leasing 24 flats in his building for a period of six months against the total consideration of 504,000/- Dirhams ($ 1,45,000/- ).

Civil Suit

The trouble started when Mr. Hassan wanted to wriggle out of the contract and was not willing to perform his obligations under the terms and conditions of the contract. In the meantime I came to know that inspite of the agreement to convey the flats to me, Hassan Saeed had sold some of these flats to others against the terms and conditions of the contract and contrary to law.

In view of the fact that he did not comply with the condition of the contract, I was advised to institute a civil suit against Mr. Hassan Saeed. The Hon' ble Judge injuncted the payment of the cheque and Mr. Hassan Saeed was unable to realise the advance payment of the contract. I sought and got permission from the Court for remitting the sum covered by the cheque in court.

On coming to know of this, Mr. Hassan Saeed threatened me of serious consequences if I failed to withdraw the civil suit and also get the order injuncting the encashment of the cheque vacated. On my refusal, Mr. Hassan Saeed in collusion with the local police, assaulted and grossly abused me beyond all imagination which no civilised society in modern world would approve or tolerate.

Serious Consequences

On 26th October 1995, around noon Hassan Saeed alongwith one of his accomplice came to my office. The day was a Thursday. Generally all the offices remain closed in the afternoon of Thursdays. Hassan Saeed and his accomplice (whom I later came to know was a police official in civil dress) threatened me again with dire consequences unless I withdraw the civil suit. I could not yield to such illegal and unjust demand which amounted to extortion. 

There upon, I was subjected to the most inhuman treatment with painful physical injuries and otherwise. The police official in civil dress beat me harshly with a chained handcuff. A few of my finger nails were seriously injured. And the chain was rounded on my neck and pulled around. The telephone connection was snapped. Mr. Hassan also enquired as to the original documents of the contract which I refused to disclose. On this, the entire office was ransacked, drawers opened, files thrown, some of the cash lying in the office locker was also taken away by them.

In the meantime, my younger brother arrived at the office with lunch. As he arrived I asked him to close the door and call the police. The policeman in civil dress managed to move out of the office. However, Mr. Hassan Saeed was unable to leave.

I noticed that the policeman in civil dress was shouting and striking on the door with an iron rod and a crowd had gathered around the office. In the meantime local police arrived at the spot. The police immediately hit me and my brother on our heads. They then handcuffed us behind our backs and pushed us around, kicked us and took us in the police car. This was all happening in front of the crowd. They took the car through some remote areas and continued their heavy blows on my head and abused us. While, the other two person, Hassan Saeed and his accomplice followed us in their vehicle. The policemen said to me that, you will be lifeless in an hour and we are going to bury you alive in the desert -You Indian bitch!

There were four persons present when they tortured me and my brother in the police station. Mr. Hassan Saeed, Mr. Abdul Khader (policeman in civil dress) and two other staff of the police department (they were also in civil dress). They clearly told me that they want to withdraw the civil suit and pay the entire balance of the contracted amount. Otherwise, they threatened that they would frame criminal charges and that I would be in big trouble. 

They shouted "We know how to teach Indians" and asked me to sign some documents. When I refused, they started again to torture me. There, I was forced to lay down on the floor by them. My face was close to the floor and my hands still cuffed behind my back. They took out their arabic turban and rolled it on my entire head and started hitting and kicking on my head with their legs. And then they tried to pullout my injured finger nails with a nail cutter. With their cruel treatment my finger nail were entirely torn apart. 

Thereupon I fell down partly unconscious. Then they started torturing my younger brother in front of me. After some time I became completely unconscious, and I was taken to hospital- emergency. Many X-rays (So far I have collected 6 Nos. from the police file) were also taken when I was unconscious.

When those atrocities were being commited in the station, people who had gathered outside were struggling to get a clue about the place to which we were taken by the police. Around 3 P.M my sponsor, Mr. Eassa Jaffer, a person belonging to Abu Dhabi met the duty officer, who is of Captain's rank. He was then told a concocted story. That the accused, who was his business partner had hit three of his police staff and a local person, and that one police official and the local man was in a serious condition and admitted in the hospital and that, they were not able to give permission to him to see the accused and his brother. After hearing such a story from a highly placed official the sponsor did not pursue the matter in view of the authoritarian methods prevalent in that country.
